1. Agreement

These Terms of Service (“Terms”) govern your access to and use of the Klub Collective website and services (the “Services”). By using our website or engaging our Services, you agree to these Terms.

2. Our services

Klub Collective provides digital marketing and AI automation services for local businesses, which may include managing a client’s Google Business Profile, publishing posts, responding to reviews, and reporting on performance. The specific scope of work is defined in the agreement between Klub Collective and each client.

3. Authorization to manage profiles

Where our Services involve managing a client’s Google Business Profile or other third-party accounts, the client authorizes Klub Collective to act on their behalf for the agreed purposes. Clients represent that they have the right to grant this authorization. Authorization may be revoked at any time through the relevant platform’s account settings, which will end our ability to perform those actions.

4. Acceptable use

You agree not to misuse the Services, including by attempting to access them without authorization, interfering with their operation, or using them to post unlawful, misleading, or infringing content. Content we publish on a client’s behalf is created in good faith and intended to be accurate; clients are responsible for the accuracy of business information they provide to us.

5. Third-party services

Our Services rely on third-party platforms, including Google. Your use of those platforms is also subject to their respective terms and policies. We are not responsible for the availability, changes, or actions of third-party services.

6. Fees

Fees, billing terms, and the term of engagement are set out in the separate agreement or proposal between Klub Collective and the client.

7. Disclaimers

The Services are provided “as is” without warranties of any kind to the fullest extent permitted by law. We do not guarantee specific marketing results, search rankings, or business outcomes.

8. Limitation of liability

To the maximum extent permitted by law, Klub Collective will not be liable for any indirect, incidental, or consequential damages arising from your use of the Services. Our total liability for any claim will not exceed the amount you paid us for the Services in the three months preceding the claim.

9. Termination

Either party may end an engagement as described in the applicable client agreement. We may suspend or terminate access to the Services if these Terms are violated.

10. Governing law

These Terms are governed by the laws of the United States and the state in which Klub Collective is established, without regard to conflict-of-law principles.

11. Messaging & SMS terms

This section describes Klub Collective’s text messaging (SMS/MMS) program and applies to anyone who opts in to receive text messages from us.

  • Program & message types. By opting in, you may receive conversational replies, appointment reminders, account and service notifications, and marketing or promotional messages from Klub Collective.
  • How you opt in. You provide express written consent by submitting your mobile number through the chat widget on our website, where the SMS consent disclosure is shown, or by otherwise giving us your number and agreeing to be texted. Consent is not a condition of purchasing any goods or services.
  • Age restriction. You must be 18 years or older to participate in our SMS program.
  • Message frequency. Message frequency varies based on your service usage and appointment schedule.
  • Message & data rates. Message and data rates may apply for messages sent to you from us and to us from you. Klub Collective does not charge for the messages themselves. For questions about your text plan or data plan, contact your wireless provider.
  • Opt out. Reply STOP at any time to unsubscribe. After you reply STOP, we will send one confirmation message and will not send further texts unless you opt in again.

  • Carriers. Mobile carriers are not liable for delayed or undelivered messages.
  • Privacy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. For privacy-related inquiries, please refer to our Privacy Policy at https://klubcollective.com/privacy-policy.
  • Compliance. We comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines, regarding the use of SMS communications.
